These terms govern the use of the condocms.net website and the CondoCMS platform (the "Platform"), provided by CondoCMS. By using the website or the Platform you accept these terms.
1. Service
CondoCMS is software as a service (SaaS) for condominium management that includes, depending on the modules contracted, fee management, payments, delinquency, electronic invoicing, bookings, announcements, visitor control, violations, assemblies and reports.
2. Accounts and access
Accounts are created by invitation from condominium management or our team. Each user is responsible for keeping their credentials confidential and for all activity under their account.
You must notify us immediately of any unauthorized use of your account.
3. Acceptable use
You agree not to:
- Use the Platform for unlawful purposes or contrary to condominium property regulations.
- Attempt to access other condominiums’ or users’ data without authorization.
- Interfere with the security, availability or operation of the service.
- Copy, decompile or resell the Platform or any part of it.
4. Condominium responsibilities
Condominium management is responsible for the accuracy of the information it records (units, ownership shares, amounts, residents), for decisions made based on it, and for having a legal basis to process its residents’ data.
5. Electronic invoicing
The electronic invoicing module transmits receipts to the Tax Administration using the information and credentials provided by the condominium. Compliance with tax obligations remains the taxpayer’s responsibility.
6. Pricing and payment
Fees are agreed in the corresponding quote or contract based on the number of units and active modules. Non-payment may result in suspension of the service after notice.
7. Availability
We work to keep the Platform continuously available, but interruptions may occur due to maintenance, third-party failures or force majeure. We will try to announce scheduled maintenance in advance.
8. Intellectual property
The software, the CondoCMS brand, the design and the website content belong to CondoCMS. Data the condominium records in the Platform remains the condominium’s property.
9. Limitation of liability
To the extent permitted by law, CondoCMS will not be liable for indirect damages, lost profits or data loss arising from the use or inability to use the Platform. Total liability is limited to the amounts paid in the previous twelve months.
10. Termination
Either party may terminate the service as agreed. Upon termination, the condominium may request an export of its data within 30 days.
11. Governing law
These terms are governed by the laws of the Republic of Costa Rica. Any dispute shall be submitted to the competent courts of San José, Costa Rica.
