Violations and fines

Violations and fines with due process, start to finish.

Each violation is a case file with deadlines, evidence, defense and a reasoned decision, so the condominium’s sanctions hold up and get collected.

What it includes

  • Violations reported from the gatehouse or management, with photos and documents.
  • Violation types with bylaw article, fine amount and severity.
  • Notice to the responsible party and a configurable defense period.
  • Mandatory reasoned decision: with a sanction, without one, or dismissed.
  • Sanctions: warning, fine, suspension of booking rights, or fine plus suspension.
  • Repeat offenses raise the fine by the factor the condominium sets.
  • Appeal: if it succeeds, the sanction is revoked and the charge voided.
  • Daily deadline reminders for management.

A fine without due process doesn’t get paid

A fine applied without notice, without a chance to respond or without stated reasons is easy to challenge. And when it isn’t collected, the message to neighbors is that the bylaws don’t matter. The problem is rarely management’s will: it’s that keeping case files, deadlines and notices on paper or in emails is very hard to sustain.

The full process in CondoCMS

1. Report with evidence

The guard or management records the violation: unit, type, date, description and evidence (photos and documents). The guard reports but doesn’t sanction.

2. Violation types defined by the bylaws

Each violation type has the bylaw article that governs it, the fine amount, its severity and a repeat-offense factor. That way identical cases are treated identically.

3. Notice and defense

The responsible party is notified of the facts and evidence, and the defense period starts. They submit their side and evidence, which go into the case file.

4. Reasoned decision

Once the period ends, management decides: with a sanction, without one, or dismissed. The system requires writing the reasons: you can’t decide with an amount and nothing else.

5. Sanction and collection

The sanction can be a warning, which counts toward repeat offenses, a fine, suspension of the right to book common areas, or a fine plus suspension. The fine is charged to the account statement, and the suspension blocks the unit’s bookings automatically.

6. Appeal

The responsible party can appeal within the deadline. A second-instance appeal can be put on the assembly’s agenda. If upheld, the sanction is revoked and the charge voided.

Deadlines nobody forgets

Defense, appeal, expiry and repeat-offense periods come from the condominium’s settings, and a daily reminder alerts management to case files with deadlines coming up.

Frequently asked questions

Can the guard issue fines?

No. The guard reports what they see, with photos, but the decision belongs to management or whoever the bylaws designate. CondoCMS keeps those permissions separate.

Which deadlines does the system use?

Those the condominium configures. By default: 10 days for the defense, 10 days to appeal, violations expire after 365 days and a 180-day repeat-offense window.

How is the fine collected?

Once the sanction is final, the fine is charged to the unit’s account statement alongside its fees. If an appeal is later upheld, the charge is voided automatically.
